MINUTE ORDER IN CHAMBERS of the Honorable Judge James C. Mahan on 7/29/2026. By Judicial Assistant: E. Santiago.
WHEREAS the court granted Nicole M. Perry's and Bethany K. Biesenthal's motion for reconsideration on its order denying their pro hac vice applications, on the condition that they (a) pass the February 2027 Nevada Bar Exam and (b) provide proof to this court certifying their admission to the Nevada bar. (ECF No. 37 ).
It has come to this court's attention that the July 2026 administration was the last administration of the legacy bar exam in this state. The state now follows the Nevada Comprehensive Licensing Examination (Nevada Plan) as its procedure for attorney licensing. Attorneys licensed and actively practicing in another state(s) for more than sixth months must pass the Foundational Law Exam (FLE), Lawyering Performance Exam (LPE), and Multistate Professional Responsibility Exam.
After careful consideration, the court hereby VACATES the currently imposed deadline for the petitioners to submit evidence that they have been admitted to the bar. Petitioners instead must submit evidence that they have passed the FLE and LPE within 30 days of the release date of the scores for the January administration of the LPE. Within three months thereafter, they must provide a status report and declaration informing the court of their licensure status with the state of Nevada.
