MINUTE entry before the Honorable Sunil R. Harjani: Motion hearing held by telephone. For the reasons stated on the record, the Court finds on preliminary review that the proposed settlement is within the range of possible approval. As a result, Commercial and Institutional Indirect Purchaser Plaintiffs' Unopposed Motion for Preliminary Approval of the Settlement Agreement with Defendant Prestage Farms, Inc., Prestage Foods, Inc., and Prestage Farms of South Carolina, LLC 169 is granted. For the reasons discussed on the record, the parties request to delay notice is also granted. Plaintiffs (CIIPS) and Defendants Butterball and JOTS shall continue to participate in settlement discussions during the month of September 2026. The Court orders these parties to update Magistrate Judge Holleb Hotaling about their settlement discussions by 9/30/26 in a confidential manner and must detail their progress; a perfunctory explanation that they are "continuing to talk settlement" will not do. The Court orders a joint status report from CIIPs, Butterball and JOTS with their trial plan and proposed trial dates by 10/15/26. A videoconference status hearing with these parties is set for 10/22/26 at 10:00 a.m. As previously mentioned, the Court urges the parties to settle their matters before this date to avoid the unnecessary time and expense associated with pretrial planning and scheduling, and should contact the Magistrate Judge if they need help with settling their matters.
