ORDER: NOW, this 18th day of June, 2026, Plaintiff having filed a Second Amended Complaint 17 without leave of this Court, IT IS HEREBY ORDERED that leave to amend is GRANTED sua sponte and nunc pro tunc. Accordingly, the Second Amended Complaint filed at ECF No. 17 shall now serve as the operative pleading in this case. Plaintiff has already amended her pleading once as a matter of course and, therefore, no further amendments may be made without the written consent of the Defendants or leave of this Court. See Fed. R. Civ. P. 15(a)(2). Based on the foregoing, IT IS FURTHER ORDERED that Plaintiff shall provide to the Court a copy of her entire Second Amended Complaint for each Defendant identified in her pleading. In addition, Plaintiff shall provide a completed USM-285 form, a Notice of Lawsuit and Request for Waiver of Summons form (AO 398), and a Waiver for Service of Summons form (AO 399) for each Defendant listed in her Second Amended Complaint. Completed service documents for each Defendant are now due by July 17, 2026. The Court notes that Plaintiff appended some completed USM-285 forms to her Second Amended Complaint; however, many of the forms are not properly completed, and the USM-285 forms cannot be processed without a valid mailing address for each Defendant. Further, Plaintiff's in forma pauperis status exempts her only from the initial filing fee. It does not exempt her from the costs of copying and filing documents and other associated litigation fees. See Porter v. Dept. of Treasury, 564 F.3d 176, 180 n. 3 (3d Cir. 2009). Therefore, Plaintiff is responsible for providing the documents outlined above, and her failure to comply with the terms of this order may result in the dismissal of her case for failure to prosecute. In light of the foregoing circumstances, IT IS FURTHER ORDERED that the within civil action shall remain administratively closed pending the Clerk's receipt of all relevant service documents. Upon the Clerk's receipt of Plaintiff's service documents, the Court will reopen the case and will direct the U.S. Marshal to complete the mailing of the service packets. Signed by Judge Susan Paradise Baxter on 6/18/2026. (snc)
