ORAL ORDER: The Court, having reviewed Plaintiff’s motion for status conference and to compel issuance of service order (“Motion”), (D.I. 6 ), hereby ORDERS that the Motion is DENIED without prejudice to renew for the following reasons: (1) The Court is unable to identify any “[c]lerical [e]rror” made by the Clerk of Court. (Id. at 2) Plaintiff’s document submitted on April 13, 2026 to the Clerk’s Office, (D.I. 5 ), was titled “Plaintiff’s Notice of Pending Service Deadline and Status of In Forma Pauperis Service of Process” and was subsequently filed on the case as the same.; (2) Plaintiff appears pro se and has been granted leave to proceed in forma pauperis. (D.I. 4 ) The Complaint is subject to screening pursuant to 28 U.S.C. § 1915(e)(2)(b) and will be screened in due course. The Third Circuit has held that for plaintiffs proceeding in forma pauperis, Rule 4(m)’s 90-day window begins after the court issues a service order. See Rivera v. New Castle Cnty. Police Dep’t, 152 F.4th 147, 152 n.5 (3d Cir. 2025).; and (3) The Court sees no need to schedule a status teleconference at this time. Ordered by Judge Christopher J. Burke on 08/14/2026. (sam)
