ENDORSED ORDER STRIKING Defendant's construed Motion for a Limiting Instruction. (Dkt. 265) The Court did not grant leave to file any additional motions, only a proposed limiting instruction. The Court proposes to give the following instruction once at the end of the trial following the punitive damages instruction: "During the trial you heard evidence concerning the size and financial condition of Oakley Transport. I instruct you that this evidence is admitted for a limited purpose. You may consider that evidence only if you have found in favor of Mr. Hardin and have decided that punitive damages should be assessed against Oakley Transport — and then only in fixing the amount of those punitive damages. You may not consider it for any other purpose." Any further discussion or argument about the punitive damages instruction will be taken up at the charge conference. Signed by Judge Mary S.
