Order on Motion for Leave to File Out of Time
ORDER. The Court held a Status Conference in this matter. Plaintiff appeared through counsel Jonathan Steele. Defendants appeared through counsel John Hicks. The Court found excusable neglect for Plaintiff's failure to timely respond to the Court's 3/30/2026 Notice and Order to Show Cause (ECF No. 5). Defendant did not object to the court's finding of excusable neglect. However, in lieu of filing Plaintiff's proposed Response to Notice and Order to Show Cause, Plaintiff shall review the caselaw discussed during the conference, propound written diversity jurisdiction discovery, and work with defense counsel to obtain the information necessary to establish the citizenship of all Defendants herein. Therefore, the Court grants in part and denies in part 18 Plaintiff's Motion for Leave to File Response to Order to Show Cause Out of Time. After discussion, the Court set the following deadlines and hearings. A Status Conference before Magistrate Gwynne E. Birzer is set for 8/18/2026 at 10:00 a.m. via Zoom. No later than 9/30/2026 Plaintiff shall file an agreed Amended Complaint and Defendants shall file an Amended Diversity Disclosure Statement pursuant to Fed. R. Civ. P. 7.1 both addressing the diversity jurisdiction issues discussed during the Status Conference. Additionally, a Scheduling Conference before Magistrate Gwynne E. Birzer is set for 10/20/2026 at 11:00 a.m. via Zoom. IT IS SO ORDERED. (This is a TEXT ENTRY ONLY. There is no.pdf document associated with this entry.) Signed by Magistrate Judge Gwynne E. Birzer on 6/12/2026. (This is a TEXT ENTRY ONLY. There is no.pdf document associated with this entry.) (kf)
