Order on Motion for Extension of Time to Complete Discovery
ORDER granting 58 Plaintiffs' unopposed motion for extension of time to complete discovery. The parties were previously notified that, "[g]iven the age of the case and the length of this extension, the parties should not expect that the Court will grant any further extensions unless unforeseeable events delay discovery and the parties can show due diligence." 4/1/2026 Order; 8/26/2026 Order. Plaintiffs' unopposed motion for extension reflects that the parties timely served their respective notices of deposition, but "due to scheduling conflicts involving the witnesses and counsel, no dates could be agreed to by" the 10/15/2026 fact discovery deadline. ECF No. 58 at 1. The parties, their counsel, and the witnesses have thus tentatively scheduled all depositions to conclude by 10/30/2026, subject to Court approval. See id. The foregoing establishes that the parties were diligent enough, and the delays were unforeseen enough, to warrant a modest extension of the fact discovery deadline. Plaintiffs' unopposed motion for extension, ECF No. 58 , is granted, and the fact discovery deadline is extended from 10/15/2026 to 10/30/2026.
Fact discovery closes 10/30/2026, by which date the parties must file a joint status letter regarding their progress on discovery. Expert discovery closes 2/12/2027, by which date the parties must file a letter certifying the close of all discovery.
Dispositive motion practice must commence by 12/15/2026, in accordance with the individual rules of the assigned District Judge. The parties are again encouraged to pursue mediation through the Court-annexed mediation program. The parties may request such a referral to the program at any time by filing a joint request on ECF.
