Order on Motion for Sanctions
ORDER: Defendant Peter Merani, P.C.'s 42 Motion for Sanctions is DENIED. In its July 19, 2021 Order, the court referred Attorney James Kernan to the Disciplinary Committee for this District. Mr. Kernan was directed to submit copies of the July 19, 2021 Order and May 27, 2021 38 Memorandum and Order to the Disciplinary Committee and to notify the Disciplinary Committee of all other ongoing and completed federal and state disciplinary proceedings against him by July 26, 2021. Since the Disciplinary Committee will determine the appropriate discipline for Mr. Kernan, the court declines to impose sanctions. Defendant may resubmit the request for attorneys fees in a motion that complies with Local Rule 7.1 for consideration by the court. Ordered by Judge Nicholas G. Garaufis on 2/10/2022.
