Order on Motion for Discovery
ORAL ORDER. The Court, having reviewed the correspondence regarding Petitioners motion for a discovery teleconference (D.I. 62, 63, 67, 68, 69, 70), hereby orders as follows. Petitioners request for two additional custodians is DENIED. In the 4 sentences that Petitioners devoted to this issue in their letter, they provided no actual argument as to why additional custodians were likely to yield additional documents, and the cited cases were largely irrelevant, providing me with no basis on which to grant the request under these circumstances. With respect to Petitioners requests regarding the privilege log, it does not appear that the parties have sufficiently met and conferred. The parties are ordered to meet and confer to discuss, among other things, the format and contents of the privilege log. Were the court asked to rule on whether a document-by-document log is appropriate in this case, depending on the submissions, it would likely be inclined to agree with Petitioners. Accordingly, the Teleconference scheduled for February 27, 2025, at 11:30 AM is cancelled. ORDERED by Judge Laura D. Hatcher on 2/26/25. (kjk)
