Order on Motion to Compel
ORDER granting 1 Motion to Compel Compliance with Subpoena by Respondent PLS Logistics Services. The Petitioner Trucksmarter, Inc. moved 1 for an Order directing the Respondent PLS Logistics Services to comply with a subpoena duces tecum issued by Petitioner in a proceeding pending in the US District Court for the Western District of Arkansas. The Court ordered the Respondent to file a reply to such Motion within 14 days of the Court's April 19, 2024 Order directing the same 4 . Per the Court's directive, the Petitioner served that Order upon known counsel for Respondent on that same date 5 . To date, no response to the Motion has been filed. The Court having examined the Motion and the subpoena at issue and concluding that such is in proper form, is not facially objectionable, and that compliance therewith should be required, the Respondent PLS Logistics Services is ORDERED to respond fully and without objection (except as to the application of a privilege to a specific item or items to otherwise be produced), and shall do so in full not later than Noon, May 28, 2024. Counsel for Petitioner shall serve this Order upon counsel for Respondent by electronic means, forthwith, and shall promptly thereafter file a certificate of such service upon the docket..
