Order to Show Cause
ORDER TO SHOW CAUSE: This Court has an independent obligation to examine its subject-matter jurisdiction sua sponte. Joseph v. Leavitt, 465 F.3d 87, 89 (2d Cir. 2006). The Complaint, ECF No. 1, does not properly allege this Court's jurisdiction under the Class Action Fairness Act (CAFA). For jurisdiction to lie under CAFA, plaintiff must satisfy a 100-plaintiff numerosity requirement and a $5 million amount-in-controversy requirement. 28 U.S.C. § 1332(d)(2). Plaintiff's Complaint does not clearly show that there is a reasonable probability that plaintiff satisfies these requirements.
In accordance with the foregoing, plaintiff shall show cause by September 25, 2026 why this case should not be dismissed for lack of subject-matter jurisdiction. Ordered by Judge Kiyo A. Matsumoto on 9/21/2026. (APC)
