TEXT ORDER - Before the Court is Plaintiff Grimaldi Deep Sea S.P.A.'s ("Grimaldi") motion for leave to file a sur-reply (ECF No. 201 ), and Defendant Port Authority of New York and New Jersey's ("Port Authority") opposition thereto (ECF No. 203 ). Permission to file a sur-reply is a matter firmly committed to the Court's discretion. See Levey v. Brownstone Inv. Grp., LLC, 590 F. App'x 132, 137 (3d Cir. 2014). "Courts in this District have granted leave to file sur-replies to address new issues in the interest of completeness, for complicated and novel legal questions, or for unusual circumstances." Derieux v. FedEx Ground Package Sys., Inc., No. 21-13645, 2023 WL 349495, at *1 n.1 (D.N.J. Jan. 20, 2023). This Court does the same. For completeness, and because this case presents complex legal questions, Grimaldi's motion is GRANTED. Grimaldi shall file its sur-reply by July 22, 2026. The Port Authority shall have until August 5, 2026 to file a reply thereto. So Ordered by Judge Julien Xavier Neals on 7/8/2026. (kd)
