ORDER. Defendants have filed a Motion to Dismiss. See ECF No. 32. On or before July 30, 2026, pursuant to Fed. R. Civ. P. 15(a)(1)(B), Plaintiff may file an amended complaint in which he pleads as many facts as possible, consistent with Rule 11, to address the alleged defects discussed in Defendants' memorandum of law. Motions to amend by Plaintiff filed after July 30, 2026 will require a showing of good cause for the delay. Fed. R. Civ. P. 16(b). Although the scheduling order issued by Magistrate Judge Farrish adopted the parties' proposal to require a showing of good cause for motions to amend filed after July 17, 2026, the court permits Plaintiff the full 21 days authorized by the Rules of Civil Procedure in which to amend the complaint once as a matter of course in response to a motion to dismiss. If Plaintiff chooses to amend and if Defendants renew the motion to dismiss, Defendants may incorporate by reference any prior briefing. If Plaintiff chooses not to amend, Plaintiff's response to the motion to dismiss is due on or before July 30, 2026. Signed by Judge Sarah F. Russell on 7/10/2026.(dl)
