Order on Motion for Protective Order Order on Motion for Extension of Time to Complete Discovery Status Report Order
ORDER: First, the parties' request for a subsequent joint status report deadline, see ECF No. 15 , is granted. On or before 10/2/2026, the parties shall file a joint status report advising the Court of the parties' progress with respect to the status of mediation and their compliance with the Scheduling Order, ECF No. 6 , for preliminary discovery and informal settlement discussions.
Second, the parties' request, see ECF No. 15 , for a protective order, ECF No. 12 , is granted, subject to the following modifications. The parties shall file a clean copy incorporating these changes on the docket, with a reference to in the ECF submission to this Order and ECF No. 12 .
The following sentence is added to the end of Paragraph (d): "If confidential information is subpoenaed, the recipient of the subpoena shall furnish opposing counsel a copy of the subpoena, or will notify opposing counsel of the subpoena, if permitted by law."
The following sentence is added to the end of Paragraph (g): "The parties will raise any such disputes in accordance with the Local Rules and the Individual Judges' Rules."
The following sentence is added to the end of Paragraph (h): "A party that seeks to file under seal any confidential information shall follow the Local Rules and the Individual Judges' Rules."
The following sentence is added to the end of Paragraph (i): "Notwithstanding this paragraph, at the conclusion of the case, counsel may retain one complete set of materials produced in the case, and any working documents reflecting such materials."
The following sentences are added to the end of Paragraph (k): "The restrictions and obligations imposed by this Protective Order do not apply to the Court and its staff. All issues related to the use of confidential information at trial shall be decided by the trial judge."
