Order on Motion to Withdraw as Attorney
PAPERLESS ORDER. THIS CAUSE came before the Court upon the Renewed Motion to Withdraw as Counsel for Plaintiff by Omar Ortega, Esq., Rosdaisy Rodriguez, Esq., and Victor A. Santana, Esq. 19 . The Court previously denied these attorneys' prior motion to withdraw without prejudice because it is "inappropriate to grant a motion to withdraw that would impermissibly leave Plaintiff pro se with no plan to retain counsel." (ECF No. 18). Now, they clarify that Plaintiff intends to retain new counsel and continue prosecuting this case. (ECF No. 19) at 2; see generally (ECF No. 20) (explaining that Plaintiff intends to continue prosecuting this case). The Court notes that the instant Motion still does not provide any sort of timeframe for when Plaintiff will retain new counsel. See generally (ECF No. 19). Accordingly, UPON CONSIDERATION of the Renewed Motion, the pertinent portions of the record, and being otherwise advised of the premises, the Motion to Withdraw 19 is DENIED WITHOUT PREJUDICE. The motion may be re-filed once Plaintiff actually retains new counsel, and that new counsel files a notice of appearance on the docket. If Plaintiff fails to retain new counsel on or before August 10, 2026, Plaintiff's Complaint 1 will be dismissed without prejudice for failure to prosecute as Plaintiff has instructed its current attorneys to refrain from acting. Defendants are ORDERED to file a notice on the docket on August 11, 2026, if Plaintiff fails to comply with this Order. Signed by Judge K. Michael Moore on 7/8/2026. (hyn)
