Order on Motion for Leave to File ~Util - Set/Reset Deadlines
TEXT ORDER: Plaintiff has 65 moved for leave to file an amended complaint. The Defendants 67 68 contest that Plaintiff's amendment sets forth a claim for relief, but they do not oppose leave to amend. (Instead, they wish to preserve their arguments for dismissing Plaintiff's complaint, which the Court expressly finds have been preserved.) Given that this case was previously stayed and remains at a preliminary stage, the Court finds that Plaintiff's amendment is proper under Rule 15(a)(2). Plaintiff also asks to file its amended complaint under seal, asserting that the Court already 57 found sealing the material appropriate. Defendants take no position on the request to seal, though State Farm suggests that Plaintiff's redactions may be overbroad because the redacted information does not constitute trade secrets. But whether the information is a trade secret forms a portion of the parties dispute on the merits. And the Court is hesitant to influence the merits of Plaintiff's trade-secret claim with a ruling on its motion to seal. Accordingly, Plaintiff's 65 motion is GRANTED. Plaintiff's First Amended Complaint and attached exhibits may remain under seal, and Plaintiff is ORDERED to file redacted copies of both no later than July 20, 2026. Defendants, in turn, must file an answer or other responsive motion to Plaintiff's First Amended Complaint on or by August 3, 2026. Entered by Magistrate Judge Ronald L. Hanna on July 13, 2026. (NL)
