OPINION AND ORDER re: 87 MOTION for Summary Judgment . filed by The National Retirement Fund, The Board of Trustees of the National Retirement Fund. ERISA's statutory command is clear: Upon a determination of default, Plaint iffs are entitled to immediate payment of all outstanding withdrawal liability and attorneys' fees, contingent upon a determination on the merits in arbitration. Thus, for the foregoing reasons, the Court GRANTS Plaintiffs' motion for summa ry judgment under Rule 56. Defendants are directed to make an accelerated payment of the entire withdrawal liability amount allegedly due based on its default within twenty (20) days of the date of this Opinion and Order, subject to a final determina tion by the arbitrator. Separately, the parties are ORDERED to meet and confer to determine whether they can agree upon a figure for reasonable attorneys' fees and costs, and thereby stave off additional litigation that could result in "fee s on fees." If the parties are unable to resolve the fees and costs issue on or before August 7, 2026, they are directed to submit a joint letter on that date proposing a briefing schedule for the Courts consideration.
