MINUTES OF ORDER DENYING PLAINTIFF'S MOTION TO REMAND 11 by Judge Stephen V. Wilson. For the foregoing reasons, the Court finds that Defendant has met its burden of establishing subject matter jurisdiction by a preponderance of the evidence. Plaintiff's motion to remand is therefore DENIED. This case will proceed under the jurisdiction of this Court. Scheduling Order
SCHEDULING ORDER: An initial conference will be held before Magistrate Judge Clay H. Kaminsky on July 30, 2026, at 12:00 p.m. in Courtroom 504 North. Removing Defendant's counsel is directed to ensure that all parties are aware of this conference. Counsel with knowledge of the case must attend the conference; per diem counsel may not appear without prior permission of the Court. The parties are directed to review Judge Kaminsky's Individual Practices and Rules in advance of the conference.
The parties must hold their Rule 26(f) planning meeting at least three weeks before the initial conference and must make Rule 26(a)(1) initial disclosures to each other at least one week before the initial conference. The parties must also complete the linked Rule 26(f) report (proposed discovery plan) and file it on ECF no later than one week before the initial conference, i.e., by July 23, 2026.
Per ECF No. 2 , this case has been assigned to Magistrate Judge Kaminsky pursuant to the EDNY Direct Assignment Program, which is established by Administrative Order 2025-15. More information about the program can be found on the EDNY Direct Assignment Program webpage. Judge Kaminsky will discuss the program with counsel at the initial conference, and the parties are directed to discuss with each other whether they will consent to Magistrate Judge Kaminsky for all purposes. Either or both parties may withhold consent to magistrate judge jurisdiction without adverse substantive consequences. Within one week after the initial conference--or contemporaneously with any dispositive motion practice prior to the initial conference--the parties are required to file either a Consent to Magistrate Judge Jurisdiction form (if all parties consent) or a Direct Assignment Program Acknowledgement form (if it is not the case that all parties consent).
