Order on Motion to Quash Order on Motion for Miscellaneous Relief
ORDER. Court hereby orders the following: Blankenship's motions regarding the bench warrant (ECF Nos. 96 , 99 ) are GRANTED IN PART insofar as they request the quashing of the bench warrant and are otherwise DENIED. The bench warrant (ECF No. 95 ) is QUASHED. Blankenship's motion to confirm compliance with this Court's orders (ECF No. 117 ) is DENIED. The two-year limitation on Defendants' operation of a fitness club, as detailed in Section 5(a) of the Court's default judgment order (ECF No. 75 at 11), did not begin to run until Blankenship's gym closed in October of 2025. If Blankenship reopens a gym during this two-year restricted period, the Court is prepared to consider a motion to reissue a bench warrant for his arrest. This matter remains closed. No motion shall be filed without the prior permission of the Court. As the Court has stated before, an email to the Court does not constitute a filing. Signed by Judge Nancy E. Brasel on 4/2/2026.
