JUDGMENT IT IS ORDERED, ADJUDGED, AND DECREED that Defendants Motions for Summary Judgment, Rec. Doc. 140 , 168 are GRANTED. Accordingly, all claims against Mitsui Sumitomo Insurance Company, Ltd., Mitsui Sumitomo Insurance USA, Inc., and Mitsui Sumitomo Insurance Company of America are DISMISSED WITH PREJUDICE.IT IS FURTHER ORDERED, ADJUDGED, AND DECREED that Plaintiffs objections to the magistrate judges report and recommendations, Rec. Doc. 151 , 171 , are DENIED. Accordingly, the Court adopts both report and recommendations. Therefore, Defendant, Kansaikikas Motion to Dismiss for Lack of Jurisdiction, Rec. Doc. 86 , is GRANTED and Plaintiffs claims against Kansaikika are DISMISSED WITHOUT PREJUDICE. The Motion to Dismiss for Lack of Jurisdiction, Rec. Doc. 92 , filed by Defendants, Nippon Steel & Sumikin Precision Machining Co Ltd. and Nippon Steel & Sumikin Fine Technology Co Ltd., is also GRANTED and Plaintiffs claims against these parties are DISMISSED WITHOUT PREJUDICE.Each party is to bear its own cost for all the above motions. Furthermore, the Court certifies the decision regarding the Motions to Dismiss for Lack of Jurisdiction for interlocutory appeal under 18 U.S.C. 1292(b). The issue of whether a federal court can exercise specific personal jurisdiction over a group of foreign companies who manufacture and sell as subcontractors custom made products presents a controlling question of law as to which there is substantial ground for difference of opinion and that an immediate appeal from this order may materially advance the ultimate termination of this litigation.
