Order on Motion for Pre Motion Conference
ORDER: Defendant's motion 49 for pre-motion conference in anticipation of its motion to dismiss is DENIED. The parties shall brief Defendant's motion to dismiss in accordance with this Courts Individual Rules and Practices. Defendant shall serve Plaintiff with its motion to dismiss on or before October 12, 2026. Plaintiff shall serve Defendant with any opposition papers on or before November 2, 2026. Defendant shall serve any reply on or before November 11, 2026. The opening brief and opposition brief shall each be no more than 25 pages, and the reply shall be no more than 10 pages. As a courtesy to the Court, unless objected to by the parties, the Court asks that the parties file the motion only once it is fully briefed. Should the parties deny the Court's request, each submission must be filed on the date it is scheduled to be served. Memoranda of law and any courtesy copies shall comply with this Courts Individual Rules and Practices.
Plaintiff is directed to file its proposed third amended complaint. The Court reserves judgment on the motion 50 to amend the complaint pending review of Defendant's motion to dismiss.
