ORDER AND REASONS: IT IS ORDERED that plaintiff's 27 Motion to Dismiss is GRANTED in part and DENIED in part as follows: plaintiff's motion to dismiss plaintiff-in-intervention's Oil Pollution Act ("OPA") claim for economic damages is DENIED, and plaintiff's motion to dismiss plaintiff-in-intervention's OPA claim for removal costs will be GRANTED, unless plaintiff-in-intervention files an amended complaint addressing the deficiencies relating to compliance with the National Contingency Plan ("NCP") within 14 days of entry of this order.
