Case Management Plan
CIVIL CASE MANAGEMENT PLAN AND SCHEDULING ORDER: This Civil Case Management Plan and Scheduling Order is submitted by the parties in accordance with Fed. R. Civ. P. 26(f)(3). All parties do not consent to conducting all further proceedings before a United States Magistrate Judge, including motions and trial. 28 U.S.C. § 636(c). This case is to be tried to a jury. Motions due by 7/10/2026. Deposition due by 10/28/2026. Fact Discovery due by 10/28/2026. Expert Discovery due by 10/28/2026. Pretrial Conference set for 11/10/2026 at 03:00 PM before Judge Jesse M. Furman. Unless and until the Court orders otherwise, the conference will be held remotely by telephone in accordance with Paragraph 3.B of the Court's Individual Rules and Practices in Civil Cases. The parties should join the conference by calling the Court's dedicated conference line at (855) 244-8681 and using access code 2303 019 3884, followed by the pound (#) key. When prompted for an attendee ID number, press the pound (#) key again. Counsel for the parties have conferred, and the present best estimate of the length of trial is 2-3 days. In the Court's experience, expert discovery and fact discovery can proceed in parallel in cases of this type; accordingly, the Court has changed the deadline for expert discovery to coincide with the deadline for fact discovery. The initial pretrial conference scheduled for June 30, 2026 at 9:00 a.m., see ECF No. 35, is hereby CANCELED. The parties should note the date of the next pretrial conference on the previous page. Additionally, the parties are reminded that a referral order to the Court-annexed mediation program remains in effect, see ECF No. 9, and that they should contact the mediation office for scheduling.
