Appellant Frank Bergren filed an emergency motion seeking to vacate the court's July 10, 2026 scheduling order, set a new briefing schedule for the appellees' motion to dismiss, and set a status conference to propose new briefing schedules. ECF Nos. 11, 12. The court can resolve this matter without a response. Although the court does not deem this an emergency, based on the representation of counsel, Bergren's amended motion (ECF No. 12 ) is granted. The parties are ordered to appear for a status conference on August 26, 2026, at 11:00 a.m. in LV Courtroom 6B. It is further ordered that Bergren's original motion (ECF No. 11 ) is denied as moot.
