Order on Motion to Reopen Case
PAPERLESS ORDER denying 22 Plaintiff's Motion to Reopen Case and Enforce Settlement Agreement, Compel Immediate Payment, and for Sanctions, Interest, Fees, and Costs. As the Court already held in its prior order, "the Court did not retain jurisdiction over this private settlement agreement; rather, it is a matter of private contract between the parties" [ECF No. 21 (citing Anago Franchising, Inc. v. Shaz, LLC, 677 F.3d 1272, 1281 (11th Cir. 2012))]. Plaintiff does not move for reconsideration of that order, electing instead to move for the same relief the Court already denied. Further, the Court's Order Administratively Closing Case 15 did not retain jurisdiction. That Order merely allowed the parties to move to reopen the case prior to the filing of any joint stipulation of dismissal in the event the "expected settlement" fell through; the Order said nothing about retaining jurisdiction 15 . Neither did the parties' Joint Stipulation 18 "condition the effectiveness of the stipulation on the district court's entry of an order retaining jurisdiction." See Anago Franchising, 677 F.3d at 1280. Rather, the parties merely "request[ed] the Court retain jurisdiction over this matter to enforce the terms of the settlement agreement entered into by the parties to resolve this matter" 18 . Therefore, this Court did not retain jurisdiction to enforce the Settlement Agreement and does not do so now. Plaintiff may initiate a new action as permitted by law. This case remains closed.
