Order on Motion for Extension of Time to File Response/Reply/Answer
PAPERLESS ORDER on 20 Defendant's Motion for Extension of Time. Defendant requests extensions of time to file a reply in support of 16 Defendant's Amended Motion to Dismiss Plaintiff's Complaint and to respond to 19 Plaintiff's Amended Complaint. Defendant, however, has not requested an extension of time to respond to Plaintiff's request for leave to amend contained within 19 Plaintiff's Amended Complaint, see ECF No. 19 at 1, and it is thus unclear whether Defendant consents to the filing of the Amended Complaint and simply intends to respond substantively to the Amended Complaint. Accordingly, it is hereby ordered that Defendant's 20 Motion for Extension of Time is granted as follows:(1) On or before August 4, 2026, Defendant shall file a notice indicating whether it consents to or opposes Plaintiff's filing of his amended complaint.(2) On or before August 14, 2026, Defendant shall respond to 19 Plaintiff's Amended Complaint and shall file its reply in support of 16 Defendant's Amended Motion to Dismiss Plaintiff's Complaint. However, if Defendant does not oppose Plaintiff's filing of 19 Plaintiff's Amended Complaint, then: (i) any motion Defendant files to dismiss the Amended Complaint shall supersede 16 Defendant's Amended Motion to Dismiss Plaintiff's Complaint and include any arguments Defendant is advancing in support of dismissal of 19 Plaintiff's Amended Complaint; and (ii) no reply in support of 16 Defendant's Amended Motion to Dismiss Plaintiff's Complaint should be filed.
