Order on Motion to Disqualify Order on Motion to Withdraw as Attorney
ORDER GRANTING 31 Motion to Withdraw and DENYING AS MOOT 23 Motion to Disqualify Counsel by Magistrate Judge Susan Prose on June 2, 2026. Milo Steven Marsden, Heath Waddingham, and Jensen Lillquist are no longer counsel for Anfield Energy Inc., and the Clerk's Office is requested to remove Mr. Marsden, Mr. Waddingham, and Mr. Lillquist from the ECF distribution list for this case. Mr. Marsden, Mr. Waddingham, and Mr. Lillquist shall serve a copy of the 31 Motion and this Order to Anfield Energy Inc. See D.C.COLO.LAttyR 5.1(b). "[A] corporation or other business entity can only appear in court through an attorney and not through a non-attorney corporate officer appearing pro se." Harrison v. Wahatoyas, L.L.C., 253 F.3d 552, 556 (10th Cir. 2001).
Accordingly, Anfield Energy Inc. may not appear without counsel admitted to the bar of this court, and absent prompt appearance of substitute counsel within 14 days of this Order, Anfield Energy Inc.'s pleadings and papers may be stricken, and default judgment or other sanctions may be imposed against it.
Because the court has GRANTED the 31 Motion to Withdraw, Plaintiff's 23 Motion to Disqualify Counsel is DENIED AS MOOT. Objections to this Order are due within 14 days. Fed. R. Civ. P. 72(a). Text Only Entry (sbplc10)
