Order on Motion for Summary Judgment
TEXT ORDER striking Plaintiff's Motion for Summary Judgment (Doc. 96) for failing to comply with the Court's Summary Judgment Procedures set forth in its June 23, 2025, Case Management Scheduling Order (Doc. 43) at 3-4). Defendant Gabriela Amarchand informs the court that Plaintiff failed to "confer in good faith with the party or parties against whom summary judgment is sought for the purpose of narrowing the factual issues in dispute" seven days before filing its motion. (Doc. 43 at 4; Doc. 97 at 2). Plaintiff also failed to file a separate "Joint Statement of Undisputed Facts" agreed upon by all parties and with citations to the record. (Doc. 43 at 4). Accordingly, Plaintiff's Motion for Summary Judgment (Doc. 96) is properly stricken. (Doc. 43 at 4). The Court reminds the parties that any "record citations should be to page and line of the filed materials." (Doc. 43 at 4). Plaintiff may file an amended motion for summary judgment on or before September 7, 2026. The Clerk of Court is DIRECTED to STRIKE Plaintiff's Motion for Summary Judgment (Doc. 96) and add a notation to the docket text stating that the document was stricken by this Order. Signed by Judge John L. Badalamenti on 8/17/2026. (YSR)
