Order Staying Case ~Util - Terminate Civil Case
ORDER STAYING AND ADMINISTRATIVELY CLOSING CIVIL ACTION FOR LACK OF ACTION BY PLAINTIFF AND ORDERING RELEASE OF FUNDS AND ORDERING PLAINTIFF TO SHOW CAUSE. The Court issued an Order on June 29, 2026, directing the Plaintiff to provide a status report to the Court as to this civil action. [ECF 33]. The Court followed up on that Order on July 9, 2026, providing a deadline of July 16, 2026, for said report. [ECF 34]. The Court has received nothing in response from the Plaintiff. The Court therefore concludes that the Plaintiff has failed to advance the conduct of its case, so it stays and administratively closes the action without prejudice and subject to be reopened by further Order. To the extent that there are any funds that are currently frozen by Order of this Court, including the Temporary Restraining Order entered in this action which there should not be, given that the Temporary Restraining Order expired by operation of Fed. R. Civ. P. 65 the Court orders such funds to be immediately released, and Plaintiff shall notify all entities holding any restrained funds forthwith that such are to be immediately released, and shall file a certificate as to such notification on the docket within 10 days of the date of this Order. The Plaintiff shall also show cause on the docket within 14 days of the date of this Order as to why this action should not be dismissed with prejudice for want of prosecution.
