OPINION AND ORDER. Great American's motion for summary judgment [ECF 93 ] is GRANTED IN PART AND DENIED IN PART. The motion is granted as to the statutory bad faith cause of action and denied as to the four remaining insurance claims described in this Order that comprise the breach of contract cause of action. Rhodium's motion for summary judgment [ECF 90 ], Rhodium's motion to strike [ECF 111 ], and Great American's motion in limine to exclude expert testimony [ECF 94 ] are all DENIED. A jury trial in this case has already been scheduled to begin on Monday, September 14, 2026, at 9:00 a.m. A pretrial conference is scheduled for Monday, August 31, 2026, at 2:00 p.m. Further instructions and deadlines can be found in the Courts Order Setting Jury Trial [ECF 119 ]. Rhodium and Great American are ORDERED to file a joint proposed consolidated pretrial order within 30 days of the date of this Order. The Clerk is DIRECTED to modify the name of Plaintiff on the docket from Yit Chee Wah to Chee Wah Yit. The Clerk is further DIRECTED to submit this Order to undersigned after 30 days.
