MINUTES OF HEARING RE: MOTION TO EXCLUDE OVERTIME CLAIM (Held and Completed) before Judge Wesley L. Hsu. For the reasons stated on the record, having considered the Parties briefing on Plaintiff's Request to Add Claim for Overtime and Violation of California Labor Code Section 510, the Court ORDERS that Plaintiff's overtime claim is excluded because Plaintiff did not put Defendant on notice of the claim until trial was imminent and adding the claim at this stage would prejudice Defendant. Plaintiff may not pursue an unpaid overtime claim at trial but may submit evidence related to the overtime theory. The Court allocates seven (7) hours per side for the liability and damages phase and one (1) hour for any punitive damages phase. Trial remains set for September 14, 2026. (lom)
