MINUTES (Text Only) for proceedings held telephonically before Magistrate Judge Helena M. Barch-Kuchta: TELEPHONIC INFORMAL DISCOVERY DISPUTE CONFERENCE held on 9/30/2026. Counsel Aisha Otori appeared for Plaintiff Hyphy Music, Inc. ("Hyphy") and Counsel Eduardo Martorell appeared for Defendant Federico Cruz ("Cruz"). The Court addressed the outstanding discovery issues with the parties. The Court orders Cruz, personally and through counsel, to comply as follows: 1. Within 7 calendar days, Cruz shall produce all nonprivileged documents responsive to Hyphy's RFPs, including documents identified in his deposition testimony, such as venue contracts; agreements concerning Gloria Posadas; visa applications, supporting records, and communications relating to Grupo Ensamble Band and other bands; financial documents within his possession, custody, or control; and responsive communications, agreements, records, and electronically stored information. 2. Within 7 calendar days, Cruz shall serve verified supplemental responses to Hyphy's RFPs to confirm that Cruz conducted a diligent search and reasonable inquiry; and identify documents withheld and the specific basis for withholding them; and include a privilege log for all materials withheld on privilege grounds. 3.Within 2 court days, Cruz shall provide Hyphy's counsel with his current mailing and physical address. 4. Cruz shall appear for a continued deposition within 14 days after completion of the supplemental production. The deposition may continue for up to four additional hours, exclusive of breaks and interpreter time. Cruz shall appear with a qualified interpreter if needed and shall be prepared to testify regarding the documents produced, the search undertaken, and any claimed inability to obtain responsive records. 5. The Court defers ruling on Hyphy's request for attorney's fees and costs at this time. Hyphy may file a motion for reasonable expenses arising from the August 18 deposition, to the extent it was rendered inefficient or incomplete by deficient production; the continued deposition; and the present discovery conference. Cruz will have an opportunity to respond to any such motion. (Deputy Clerk YV)
