Order [non-document]: Defendant Morgan Stanley seeks leave to file instanter a sur-reply addressing "seven misstatements of the record" in Plaintiff's reply brief in support of its complaint/motion to vacate the arbitration award. (See Doc. Nos. 14 and 15.) Plaintiff opposed Defendant's motion for leave. (Doc. No. 17.) While sur-replies are generally disfavored, the Court has discretion to accept and consider a sur-reply that addresses arguments or factual assertions lodged for the first time in a reply brief. E.g., Key v. Shelby Cnty., 551 F. App'x 262, 265 (6th Cir. 2014). While Plaintiff disputes that any factual misstatements were made in reply, the Court's obligation to consider all of the relevant facts and arguments weighs in favor of considering the sur-reply in this instance. Accordingly, Defendant's motion (Doc. No. 15) is GRANTED, and the sur-reply attached to the motion as Exhibit A will be made part of the record and considered by the Court. IT IS SO ORDERED.
