MINUTE entry before the Honorable Keri L. Holleb Hotaling: The Romeoville Defendants' Opposed Motion for Extension of Time to Complete Deposition of DePalmer [Dkt. 244] is GRANTED. The Court finds the Romeoville Defendants timely and appropriately served DePalmer with a deposition subpoena in March 2026 [Dkt. 244 at Para 3; Dkt. 244-1; Dkt. 244-2]. The delay in taking DePalmer's deposition has not been caused by Defendants. The Court finds Plaintiff's arguments regarding the alleged "unreliability" or lack of "helpfulness" from the expected testimony of DePalmer unpersuasive in determining whether to allow the extension of time to allow her deposition to proceed. Those arguments are for the trier of fact to determine. By 6/22/2026, the Romeoville Defendants are to file a short (no more than one page) status report concerning what happened at the 6/10/2026 Rule to Show Cause hearing regarding the deposition of DePalmer in the SDIL and to provide a proposed date by which DePalmer will be deposed. The Court will then determine the date by which it will hold open fact discovery for the sole purpose of allowing the Romeoville Defendants to take DePalmer's deposition (which will not be an indefinite time period). Again, the Court reiterates its understanding from the parties that this third-party deposition should have no impact on the expert discovery schedule in this matter. (rbf, ) (Entered: 06/17/2026)
