ORDER by the District Judge Scott W Skavdahl DENYING 220 Motion to Stay Case. Mr. Ungerman has not carried his burden of showing a stay of discovery in this lawsuit is justified under the circumstances. While the claims asserted against the defendants are unquestionably "intimately intertwined," Mr. Ungerman has not shown discovery from the Bankrupt Corporate Defendants concerning the claims against the non-bankrupt defendants is barred by the automatic bankruptcy stay, and indeed the weight of caselaw appears to be to the contrary.
