TEXT ORDER: The Court has reviewed the docket in this action and the discovery disputes addressed across the parties' 22-page July 15, 2026 dispute letter. [D.E. 266]. Before the Court acts, that parties shall meet and confer by video conference (unless that is impossible for reasons not raised during the August 17, 2026 teleconference) and make every reasonable effort to narrow the scope and volume of current disputes, mindful of Judge Hammer's recent observation that appointment of a special discovery master may be appropriate in this action. On or before September 9, 2026, the parties shall file a joint letter (not exceed 14 pages at 1.5 line spacing) identifying what disputes are resolved, which remain, and sharpening their views on those remaining disputes. That letter shall also address in more detail the parties' views about the necessity and wisdom of appointing a special discovery master. Finally, the Court will hold an in-person hearing on September 15, 2026, at 10:00 a.m., in Courtroom 2D of the Martin Luther King Courthouse at 50 Walnut Street, in Newark. Counsel shall be prepared to address any remaining discovery disputes during that hearing. All clients shall be immediately available by telephone during that hearing.
