MINUTE ORDER issued by the Courtroom Deputy for District Judge Dena M. Coggins on 6/23/2026: In Respondents' 8 Opposition to Petitioner's 2 Motion for a Temporary Restraining Order, Respondents contend that Petitioner's Habeas Petition should be denied as moot because "Petitioner has a bond hearing scheduled for June 17, 2026." In his 9 Reply, Petitioner argues that Petitioner should not be required to exhaust his administrative remedies through a bond hearing because he challenges the constitutionality of his ongoing detention, and the "immigration court cannot make determinations regarding these constitutional issues thus a bond hearing would not cure this constitutional defect." The ultimate relief sought by Petitioner's 2 Motion for a Temporary Restraining Order, however, is his release from immigration custody. Thus, if Petitioner is released as a result of his bond hearing, Petitioner's 2 Motion for a Temporary Restraining Order would be rendered moot, and his constitutional claims could proceed with his Habeas Petition. Accordingly, Respondents shall, by no later than 6/25/2026, file a status update regarding the outcome of Petitioner's bond hearing.
