Pending before the Court is BB8's Motion for Leave to File Exhibits C, D, and E to the Declaration of John Taylor Under Seal. ECF No. 93 . BB8 seeks to seal screenshots from a website and two related social media posts. Id. at 2. While the Court appreciates BB8's contention that the posts and website contain information that is allegedly inaccurate and posted in violation of a Non-Disclosure Agreement, the information was nevertheless published on the internet. It is well settled that requests to seal documents already made publicly available do not meet the good cause standard. E.g. Nalco Co., v. Turner Designs, Inc., Case No. 13-CV-02727 NC, 2014 WL 12642193, at *2 (N.D. Cal. Oct. 30, 2014). BB8 does not represent in its Motion that the website and social media posts are no longer publicly accessible.
Accordingly, IT IS HEREBY ORDERED that BB8's Motion for Leave to File Exhibits C, D, and E to the Declaration of John Taylor Under Seal (ECF No. 93 ) is DENIED without prejudice.
IT IS FURTHER ORDERED that the documents appearing at ECF No. 94 will remain temporarily sealed pending BB8's Renewed Motion.
IT IS FURTHER ORDERED that BB8 may refile its Motion to Seal, explaining why good cause exists to seal these documents information that appears to be publicly available no later than August 31, 2026.
IT IS FURTHER ORDERED that absent a showing of good cause, Exhibit C, D, and E to the Declaration of John Taylor will be unsealed.
