Any and all claims asserted in the above-entitled action by and among the Parties are dismissed WITH PREJUDICE, subject to the Parties' respective rights and obligations set forth in their Confidential Settlement Agreement between the Parties, and with each party bearing its own costs; and 2. This dismissal will have no preclusive effects on any matters not resolved by the Parties' Confidential Settlement Agreement; and 3. This Court retains jurisdiction over the Parties and the subject matter for the purpose of enforcing their Confidential Settlement Agreement and the Qualified Settlement Fund.
