Status Conference ~Util - Case Referred to Judicial Officer for Mediation or Settlement
Minutes of proceedings: [non-document] A Telephone Status Conference was held on April 2, 2024 at 9:45 AM. Present at the Status Conference were Benjamin Ockner for Plaintiff, and Adam Uth and Anthony Coyne for Defendant. The parties discussed the status of discovery and indicated that they disagree over whether Plaintiffs may properly notice the City of South Euclid's law director for a deposition. The Court observed that the fact discovery deadline has passed, and none of the parties moved to extend the deadline before it expired. The Court's Case Management Order filed October 3, 2023 requires parties seeking to extend a case deadline to file a motion "BEFORE the deadline at issue has passed." (ECF No. 12 , PageID #214). The Court indicated that, if the parties cannot resolve the discovery dispute, they must brief the issue to the Court. The parties also indicated that they are amenable to mediation with the assigned magistrate judge. This matter is hereby referred to Magistrate Judge Jonathan Greenberg for the purpose of conducting a mediation. All dates associated with the mediation, including deadlines relating to additional, pre-mediation discovery, shall be set by Magistrate Judge Greenberg. All case management deadlines are hereby STAYED pending the outcome of the parties' mediation. In the event that mediation is unsuccessful, the Court will set a case management conference to establish new dates/deadlines for the case. IT IS SO ORDERED. Judge Charles Esque Fleming on 4/10/2024.
