TEXT ORDER: The parties have advised the Court that following their prior "notification to the Court that the matter had resolved, there was a delay in finalizing the settlement due to issues relating to the resolution of the Medicare lien." Docket Item 40 at 1. As such, they need more time to obtain approval from the Cattaraugus County Surrogates Court. See id.
For that reason, the parties shall update the Court on the status of the Cattaraugus County Surrogates Court proceedings on or before 11/23/2026. If those proceedings are completed before that date, in lieu of providing a status update the parties may jointly move for settlement approval under Local Rule of Civil Procedure 41(a)(2).
