Order on Motion to Compel Order on Motion for Hearing
PAPERLESS ORDER on 127 MOTION to Compel Payment Details by Jorge de Jesus A&ntildeez Dager ("Respondent"). After the Motion was filed, Petitioner provided the payment details. (ECF No. 130 at 5). Thus, the portion of the Motion which seeks to compel payment details is DENIED as moot.
The only remaining issue is Respondent's request for attorney's fees and costs associated with filing the Motion. Respondent invokes the Court's inherent power and 28 U.S.C. § 1927 and asserts that Petitioners' counsel failed to respond to Respondent's counsel's multiple efforts to confer. (ECF No. 127 at 3-4). "The key to unlocking a court's inherent power is a finding of bad faith." Purchasing Power, LLC v. Bluestem Brands, Inc., 851 F.3d 1218, 1223 (11th Cir. 2017). The Court may impose sanctions under § 1927 against an attorney who "multiplies the proceedings in any case unreasonably and vexatiously." 28 U.S.C. § 1927.
At this time, the Court will DENY Respondent's request for attorney's fees and costs. However, Petitioners' counsel is reminded that the conferral obligation is a two-way street. See S.D. Fla. L.R. 7.1(a)(3) (stating that "[c]ounsel conferring with movant's counsel shall cooperate and act in good faith in attempting to resolve the dispute" and the failure to do so "may be cause for the Court to... impose on counsel an appropriate sanction, which may include an order to pay the amount of the reasonable expenses incurred because of the violation, including a reasonable attorney's fee.").
Accordingly, because the Motion has been ruled on, the July 16, 2026 hearing before the undersigned is CANCELLED. Respondent's motions to reschedule the hearing (ECF Nos. 142 , 143 ) are DENIED as moot. Signed by Magistrate Judge Lauren Fleischer Louis on 7/14/2026. (mk01)
