Order on Motion for Hearing Order on Motion to Show Cause
ORDER finding as moot 60 Motion for Hearing; finding as moot 60 Motion for Order to Show Cause; finding as moot in part and denying in part 63 Motion for Order to Show Cause. Defendants moved for show cause and contempt proceedings against three nonparties to this suit for failure to comply with subpoenas. Two of the nonparties to whom Defendants sent subpoenas have since responded. Accordingly, the Court finds Defendants' Motions for show cause orders and contempt hearings against Tri-State Orthopedics and Ascension St. Vincent Evansville MOOT. (Doc. 60, 63). As to the third nonparty, Deaconess Midtown Hospital, Defendants have indicated that their true objective is compliance with the subpoena. (Doc. 68, p. 6). They further indicate that Deaconess Midtown Hospital is currently reviewing the subpoena. Id. The Court notes that the subpoena issued by Defendants was delivered on 5/11/26 and Defendants moved for a show cause hearing ten days later, on 5/21/26. In light of these considerations, the Court finds that a show cause hearing is not appropriate at this time. Defendants' Motion for a show cause hearing as to Deaconess Midtown Hospital is DENIED.
