Judge Richard G. Stearns: ELECTRONIC ORDER entered granting in part and denying in part 74 Motion for Extension of Time. Filed in January of 2025, this is a case brought under the Fair Debt Collection Practices Act about a car that was wrongfully repossessed and returned a few days later. The Complaint asserts that the repossession was illegally carried out by JMAC Distribution because it is not licensed to operate as a debt collector in Massachusetts. The demand, which will need to be substantiated, is $100,000. The case has become a morass of cross-claims, counterclaims, and third-party defendants involving nine different counsel.The court will allow an extension to the discovery schedule as follows, and warns there will be no further. The court directs counsel to make available to newly-added third party defendant CarMax Auto Superstores, Inc., within the next ten days (by 9/11/26) all automatic disclosures it has made to the other parties, previously written discovery and document production responses. Any depositions transcripts can be obtained through the court reporter. Fact discovery will be completed by November 23, 2026. Any dispositive motions will be filed by December 14, 2026, with opposition by January 4, 2027. Decisions to participate in the court's mediation program (with the Magistrate Judges) must be made by November 18, 2026, to facilitate scheduling a timely mediation. (MZ)
