ORDER, by docket entry only: On August 17, 2026, the Court entered an 46 Order denying Plaintiffs' 45 Motion for Default Judgment as to Defendant Christopher Prescott without prejudice and directing Plaintiffs to file an amended motion on or before September 4, 2026. That date has passed, and Plaintiffs have not filed an amended motion for default judgment or otherwise taken any further action in this matter. Accordingly, Plaintiffs are ORDERED to SHOW CAUSE why their claims against Defendant Christopher Prescott should not be dismissed for failure to prosecute pursuant to Fed. R. Civ. P. 41(b). Plaintiffs must respond to this Order to Show Cause no later than September 30, 2026, either by voluntarily dismissing their claims against Christopher Prescott or by filing an amended default judgment motion with proper evidence provided in accordance with the Court's August 17, 2026 Order. Failure to take either of these two actions by the deadline will likely result in the dismissal of Plaintiffs' claims against Christopher Prescott under Rule 41(b).
