MINUTES OF IN CHAMBERS - ORDER RE PLAINTIFF JEHAN SEMPER'S NOTICE TO THE COURT REGARDING THE UNITED STATES MARSHALS SERVICE'S REFUSAL TO SERVE REINSTATED DEFENDANTS by Judge Dolly M. Gee: Plaintiff Jehan Semper filed a "notice" that the United States Marshals Service ("USMS") has declined to serve the Defendants who were reinstated in this action by the Court's order at Doc No. 52, to wit, "Whole Foods, Whole Foods Market LLC, Whole Foods Market California, Inc., and Mrs. Gooch's Natural Food Markets, Inc." 78 . On this occasion and due to Plaintiff's pro se status, the Court will construe Plaintiff's "notice" as a motion to order the USMS to serve these Defendants. Plaintiff is advised that Defendants have already appeared in this action via their Motion to Dismiss [Doc No. 53], including noting that Defendants "Whole Foods Market LLC" and "Whole Foods" are not separate legal entities and not raising any defense relating to service of process. The Court ordered Defendants to answer the First Amended Complaint [Doc No. 77]. Accordingly, there is no further need for service of the summons and complaint on them. The Court DENIES Plaintiff's motion to serve as moot. Court Reporter: Not Reported. (gk)
