ORDER granting in part and denying in part 84 Letter Motion for Extension of Time; granting in part and denying in part 86 Letter Motion for Leave to File Document. It is hereby ORDERED that Defendants' request for leave to amend their Answer is DENIED. Defendants have already asserted the affirmative defense at issue and may rely on discovery obtained in this action in support of that defense. It is further ORDERED that Plaintiff's request for leave to amend its response to Defendants' Request for Admission No. 21 is GRANTED. Plaintiff shall serve its amended response by August 11, 2026. It is further ORDERED that Plaintiff's request for discovery regarding the January 2026 transaction is GRANTED in part and DENIED in part. Plaintiff shall serve document requests concerning the January 2026 transaction by August 11, 2026. Defendants shall serve any responses and objections by September 10, 2026, and shall produce all responsive, non-privileged documents by September 17, 2026. Plaintiff's request to depose a witness regarding the January 2026 transaction is DENIED without prejudice to renewal after receipt of the documents. The parties are encouraged to consider whether interrogatories may resolve any remaining factual issues in lieu of a deposition. It is further ORDERED that parties' request for a pre-motion conference is DENIED as moot. The Clerk of Court is respectfully directed to close the letter motions at Dkt. Nos. 84 and 86.
