PRETRIAL ORDER #44 MEMORANDUM OPINION AND ORDER denying the 306 Objection; directing the distribution as recommended in Judge Stacks modification to the FCCs Final Written Recommendation; further directing the chairman of the FCC to direct the accounting firm holding the fund to distribute the 30% of common benefit monies received that were withheld for purposes of common benefit work and expenses as more fully set forth herein; the court ORDERS that all expenses noted in the External Review Specialists Recommended Allocation of Expenses be dispersed to each firm according to the Total Expense Reimbursement column of the recommendation; the Court ORDERS that the common benefit funds accounting firm, Smith Cochran & Hicks, to disburse those funds according to the External Review Specialists Recommended Allocation of Fees percentages that are listed under the External Review Specialists Recommended Allocation column of the second round recommendation; Smith Cochran & Hicks is further ORDERED to continue to disburse 70% of the common benefit funds received in accordance with my prior order and to disburse 30% of the common benefit funds received in accordance with the External Review Specialists Recommended Allocation of Fees percentages that are listed under the External Review Specialists Recommended Allocation column of the second round recommendation.
