Minute Order ~Util - 1 Terminate Deadlines and Hearings Order on Motion to Amend the Complaint Order on Request to Seal
MINUTE ORDER issued on 6/22/2026 by the Courtroom Deputy for District Judge Dena M. Coggins: On 6/18/2026, Plaintiffs filed a 106 Motion to File a Third Amended Complaint and an associated 108 Notice of Request to Seal, but, despite Plaintiffs' efforts, that Motion does not comply with the meet and confer requirement in the court's [33-1] Standing Order, which states: "Prior to filing a motion in a case in which the parties are represented by counsel, counsel shall meet and confer to meaningfully discuss the substance of the contemplated motion and potential resolution. Counsel should resolve minor procedural or other non-substantive matters prior to filing the motion. The briefing on motions should be directed to substantive issues requiring resolution by the court. A notice of motion shall contain a certification by counsel filing the motion that meet and confer efforts have been exhausted, with a brief summary of the parties' meet and confer efforts." (See Doc. No. 33-1 at 2.) Plaintiffs' Notice of Motion details their Counsel's efforts to meet and confer with Defendants' Counsel, however, Defendants' Counsel was not responsive to those efforts. Accordingly, Plaintiffs' 106 Motion and associated 108 Request to Seal are hereby DENIED, without prejudice to Plaintiffs filing a Motion for Leave to File a Third Amended Complaint after meaningfully meeting and conferring with Defendants. In light of this Order, the Motion Hearing set for 8/7/2026 before District Judge Dena M. Coggins is VACATED. (Text Only Entry) (Deputy Clerk CRS)
