Order on Motion for Extension of Time
PAPERLESS ORDER. THIS CAUSE came before the Court upon Plaintiff's Motion for Enlargement of Time to Effectuate Service of Process on Defendants Adam Cortese and Goran Rajsic. 34 . Therein, Plaintiff requests an extension of ninety (90) days to serve Defendants Cortese and Rajsic. Id. at 4. Plaintiff states it has "been in consistent communication with counsel who has been retained to represent" Defendant Cortese, and Plaintiff is now waiting to learn if Cortese's counsel is "permitted to accept the waiver of service on Cortese's behalf." Id. at 2. Further, Plaintiff has located a residential address belonging to Defendant Cortese and Plaintiff "intends to utilize the extension of time to attempt service on this recently discovered address." Id. (also detailing Plaintiff's unsuccessful attempt to serve Defendant Cortese at his principal place of business). As to Defendant Rajsic, Plaintiff unsuccessfully attempted to serve him at his principal place of business and has also been unsuccessful in securing a response from his known counsel. Id. at 3. Plaintiff has since learned that Defendant Rajsic resides in the United Arab Emirates, so Plaintiff "intends on utilizing the mechanisms afforded within Fed. R. Civ. P. 4(f) to effectuate service of process on an individual within a foreign country." Id. The Court finds Plaintiff has diligently attempted to serve Defendants Cortese and Rajsic, and has demonstrated good cause justifying an extension of time. At this time, however, the Court does not deem it necessary to grant an extension of the length requested. Accordingly, UPON CONSIDERATION of Plaintiff's Motion, the pertinent portions of the record, and being otherwise advised of the premises, it is hereby ORDERED AND ADJUDGED that the Motion 34 is GRANTED IN PART. Plaintiff's deadline to effectuate service upon Defendants Cortese and Rajsic is now October 2, 2026. Signed by Judge K. Michael Moore on 8/17/2026. (hyn)
